These Terms of Service ("Terms") govern your use of Fixture, Inc.'s customer relationship management platform, including fixture.app, our web app, APIs, browser extension, and related services (collectively, the "Services").
By using the Services, you agree to these Terms.
1. Accounts and Access
You are responsible for:
- Keeping account credentials secure
- Ensuring account information is accurate
- Using the Services only for lawful business purposes
You may not misuse, disrupt, or attempt unauthorized access to the Services.
2. Customer Data
You retain ownership of data you submit to the Services, including CRM records and related content.
You grant Fixture the rights needed to host, process, and transmit your data solely to provide, maintain, and improve the Services and to meet legal obligations.
Fixture does not use Customer Data to train general-purpose machine learning models.
3. Fees, Billing, and Renewal
Paid subscriptions are billed monthly or annually, as selected, and renew automatically unless canceled before the next billing date.
Except as required by law, fees are non-refundable.
4. Acceptable Use
You may not use the Services to:
- Violate law or third-party rights
- Distribute malware or abusive content
- Attempt to probe, scan, or circumvent security controls
We may suspend or limit access for violations of these Terms.
5. Service Changes and Availability
We may update, modify, or discontinue features over time.
We strive for reliable service but do not guarantee uninterrupted availability.
6. Termination
You may stop using the Services at any time.
We may suspend or terminate access for material Terms violations, legal requirements, or security risk.
7. Warranty Disclaimer
To the maximum extent permitted by law, the Services are provided "as is" and "as available," without warranties of any kind, express or implied.
8. Limitation of Liability
To the maximum extent permitted by law, Fixture will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, or data.
Fixture's aggregate liability for claims arising from the Services is limited to the amounts paid by you to Fixture in the 12 months before the event giving rise to the claim.
9. Changes to These Terms
We may update these Terms from time to time. Continued use of the Services after updates become effective constitutes acceptance of the revised Terms.
